Terms and Conditions

These Terms govern all services provided by Horizon Pack & Ship and Horizon Business Hub, including all current and future subscription offerings. Please read carefully before using any service.

Section 01

About These Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Customer," "Member," or "Client") and Horizon Pack & Ship LLC, doing business as Horizon Pack & Ship and Horizon Business Hub ("Company," "we," "us," or "our"), with principal operations in Hardin County, Kentucky.

By visiting any Company location, using any online service, enrolling in any subscription, or engaging any service offering, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.

If you are entering into these Terms on behalf of a business entity, you represent and warrant that you have the authority to bind that entity. These Terms apply to all physical locations, digital platforms, subscription products, and any services added in the future.

Note: These Terms supersede all prior agreements, verbal representations, and communications regarding the subject matter herein.

Section 02

Services Covered

These Terms govern all services offered by the Company, including but not limited to:

Horizon Pack & Ship

  • Package taping, sealing, and preparation
  • Shipping label printing and application
  • Carrier drop-off services (UPS, FedEx, DHL, USPS, and others)
  • Packing supplies retail sales
  • Zero-Worry Club and any future Pack & Ship subscription tiers
  • Any new in-store services introduced at any Horizon Pack & Ship location

Horizon Business Hub

  • Business automation consulting and implementation
  • CRM setup, configuration, and management services
  • Marketing funnel and landing page development
  • GoHighLevel (GHL) platform services and sub-account management
  • Operations workflow design and deployment
  • All current subscription tiers and any future tiers introduced

Future Services

Any new service, product, subscription, or offering introduced by the Company under the Horizon brand shall automatically be governed by these Terms unless a separate, superseding agreement is executed in writing.

Section 03

Eligibility

To use Company services you must be at least 18 years of age, or the age of majority in your jurisdiction. By using our services you represent and warrant that you meet this requirement.

Business accounts require the enrolling individual to be an authorized representative of the business entity. The Company reserves the right to verify identity or business authorization at any time and to deny service at its sole discretion.

Subscriptions and accounts are non-transferable. Sharing of subscription access, credentials, or membership benefits with unauthorized third parties is prohibited and grounds for immediate termination without refund.

Pack & Ship
Section 04

Pack & Ship Services

4.1 Tape and Seal Service

The Company will apply commercial-grade tape to seal packages presented at any Horizon Pack & Ship location. Standard pricing is $3 per box for tape and seal only, or $4 per box when label printing is included. These prices are per service, not cumulative — one price applies per transaction type per box.

4.2 Label Printing

Customers requesting label printing are solely responsible for providing accurate and complete shipping information, including but not limited to: recipient name, delivery address, declared package weight, selected service level, and any required customs information for international shipments. The Company is not responsible for undeliverable, delayed, or misdirected packages resulting from inaccurate information provided by the Customer.

4.3 Carrier Drop-Off

Horizon Pack & Ship is an authorized UPS Outlet, certified FedEx ShipCenter, and DHL partner. Drop-off of packages for third-party carriers is subject to each carrier's terms of service, rates, and liability policies. The Company acts as an authorized agent, not as the carrier.

4.4 Package Acceptance

The Company reserves the right to refuse any package that contains prohibited, hazardous, or illegal contents as defined by applicable federal, state, or carrier regulations. Presenting prohibited items for shipment may result in immediate termination of membership without refund and may be reported to relevant authorities.

Prohibited items include but are not limited to: hazardous materials, narcotics, firearms without proper documentation, live animals, perishables without proper packaging, and any item prohibited under 49 C.F.R. Parts 171-180 (PHMSA) or applicable carrier tariffs.

4.5 Zero-Worry Guarantee

If a package sealed by Company staff fails in transit due solely to a sealing defect attributable to the Company's workmanship, the Company will re-seal the replacement package at no charge. This guarantee applies only to packages sealed by Company staff and is void if damage is caused by: carrier mishandling, improper packaging by the Customer, incorrect weight or dimension declarations, prohibited or fragile contents, or any cause outside the Company's direct workmanship.

This guarantee does not constitute an insurance policy and does not entitle the Customer to compensation for the value of contents, shipping fees, or business losses of any kind.

Section 05

Subscriptions

5.1 Enrollment

Subscription enrollment constitutes acceptance of these Terms and authorizes the Company to charge the applicable recurring fee on the schedule disclosed at enrollment. Subscriptions begin on the date of enrollment unless otherwise specified.

5.2 Automatic Renewal

All subscriptions renew automatically at the end of each billing period unless cancelled. By enrolling, you expressly authorize recurring charges to your payment method. You will receive notice of any price change no less than 30 days prior to the change taking effect, as required under applicable Kentucky consumer protection law.

5.3 Multi-Location Access

Active subscriptions to Horizon Pack & Ship membership tiers are honored at all current and future Horizon Pack & Ship locations. As new locations open, existing subscribers gain access automatically at no additional charge, provided their subscription remains active and in good standing.

5.4 Subscription Tiers

The Company reserves the right to add, modify, or discontinue subscription tiers at any time. Existing subscribers on a discontinued tier will be notified no less than 30 days in advance and offered the option to migrate to an equivalent tier or cancel without penalty.

5.5 Free Trial Periods

Where a free trial or promotional first period is offered, the Customer's payment method will be charged the standard subscription rate at the end of the trial unless cancelled prior to the trial expiration date. Trial eligibility is limited to one trial per person, per subscription product.

Section 06

Billing and Payment

6.1 Accepted Payment Methods

The Company accepts cash, major credit and debit cards, and approved digital payment methods. Payment is due at the time of service for one-time transactions. Subscription fees are charged on the billing date established at enrollment.

6.2 Failed Payments

If a recurring payment fails, the Company will attempt to collect payment for up to 3 business days. If payment is not successfully collected, the subscription will be suspended. During suspension, membership benefits are not accessible. The subscription will be terminated if payment is not collected within 7 days of initial failure. The Customer is responsible for any fees associated with declined or returned payments.

6.3 Price Changes

The Company reserves the right to modify pricing for any service or subscription. For subscription services, price changes will be communicated via the email address on file no less than 30 days before the effective date, as required under KRS 367.46951 and applicable federal disclosure standards.

6.4 Taxes

Applicable Kentucky state sales tax and any local taxes will be added to transactions where required by law. The Customer is responsible for all taxes applicable to their use of Company services.

Section 07

Cancellation and Refunds

7.1 Cancellation by Customer

Customers may cancel any subscription at any time by notifying a Company representative in person at any Horizon Pack & Ship location, or in writing to the contact information provided in Section 20. Cancellation takes effect at the end of the current paid billing period. Access to subscription benefits continues through the end of the paid period.

7.2 No Prorated Refunds

Subscription fees are not refunded on a prorated basis for partial billing periods. The Customer retains full access to benefits through the end of the period for which payment was received.

7.3 Refund Eligibility

One-time service transactions are generally non-refundable once service has been rendered. Exceptions may be made at the Company's sole discretion in cases of demonstrable Company error. Requests for refunds must be made within 14 days of the transaction date.

7.4 Cancellation by Company

The Company reserves the right to suspend or terminate any account or subscription immediately and without advance notice in cases of: violation of these Terms, abuse or harassment of staff, fraudulent activity, or failure to pay. In such cases, no refund will be issued for the current or any prior billing period.

Kentucky Notice: Under KRS 367.46951, Kentucky consumers enrolled in automatic renewal subscriptions have the right to cancel at any time. We honor this right with no cancellation fees and no penalty.
Business Hub
Section 08

Horizon Business Hub Services

8.1 Scope of Services

Horizon Business Hub provides business automation, CRM implementation, marketing funnel development, and operations consulting services. The specific scope of services, deliverables, timelines, and pricing will be outlined in a separate Statement of Work ("SOW") or Service Agreement executed between the Company and the Client. In the absence of a separate SOW, these Terms govern.

8.2 Client Responsibilities

The Client is responsible for providing accurate business information, timely feedback, access to required platforms and credentials, and any content or assets needed for service delivery. Delays caused by failure to provide required information may affect timelines and do not constitute grounds for refunds or disputes.

8.3 Third-Party Platforms

Services may involve third-party platforms including but not limited to GoHighLevel, HeyGen, and others. The Client acknowledges that use of these platforms is subject to each platform's own terms of service. The Company is not responsible for changes, outages, pricing adjustments, or policy changes by third-party platforms. Third-party platform subscription costs are the sole responsibility of the Client unless expressly included in a signed agreement.

8.4 Intellectual Property of Deliverables

Upon full payment for a specific deliverable, the Client receives a non-exclusive license to use that deliverable for its intended business purpose. The Company retains the right to reuse frameworks, methodologies, and non-client-specific code or design elements. Custom deliverables containing Client-specific branding, copy, or data are treated as work product and ownership transfers to the Client upon full payment.

8.5 No Guarantee of Results

The Company does not guarantee specific business outcomes, revenue results, lead generation volumes, or conversion rates from any service. Marketing and automation services involve inherent variability based on market conditions, platform algorithms, and factors outside the Company's control.

8.6 Confidentiality

Both parties agree to keep confidential any proprietary business information shared during the engagement. This obligation survives termination of the service relationship for a period of two years.

Section 09

Prohibited Use

You agree not to use Company services to:

  • Ship, facilitate, or conceal illegal goods, substances, or activities
  • Violate any federal, state, or local law or regulation
  • Harass, threaten, or abuse Company staff or other customers
  • Misrepresent the contents, weight, or dimensions of any package
  • Circumvent carrier security protocols or export controls
  • Use Business Hub services to engage in deceptive marketing practices in violation of FTC regulations (15 U.S.C. 45)
  • Share, resell, or transfer subscription benefits to any third party
  • Attempt to circumvent subscription or payment systems by any means
  • Use automation or bulk access in a manner that disrupts service availability for other customers

Violation of this section may result in immediate termination of all services and accounts, forfeiture of any prepaid amounts, and referral to law enforcement where applicable.

Section 10

Carrier Liability and Shipping Terms

10.1 Third-Party Carrier Responsibility

Once a package is accepted by the carrier, all liability for loss, damage, or delay transfers to the carrier under the carrier's published tariff and terms of service. The Company does not insure packages on behalf of Customers unless expressly agreed in writing.

10.2 Declared Value and Insurance

Carriers limit liability based on declared value. Customers shipping items of significant value should declare full value and purchase carrier insurance or third-party insurance coverage. The Company strongly recommends purchasing shipping insurance for any package valued over $100. Failure to do so is at the Customer's sole risk.

10.3 Federal Shipping Regulations

All shipments are subject to applicable federal regulations including but not limited to: the Pipeline and Hazardous Materials Safety Administration (PHMSA) regulations under 49 C.F.R., USPS Mailing Standards (Domestic Mail Manual), and applicable Export Administration Regulations (EAR) for international shipments.

10.4 International Shipments

Customers are solely responsible for compliance with import/export regulations, customs declarations, duties, taxes, and restricted item rules for all destination countries. The Company provides no customs advisory services unless expressly contracted.

Section 11

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY'S TOTAL LIABILITY TO ANY CUSTOMER FOR ANY CLAIM ARISING FROM OR RELATED TO SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY THAT CUSTOMER TO THE COMPANY IN THE 30-DAY PERIOD IMMEDIATELY PRECEDING THE CLAIM.

THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION: LOST PROFITS, LOST REVENUE, LOSS OF DATA, BUSINESS INTERRUPTION, DAMAGE TO GOODWILL, OR COST OF SUBSTITUTE GOODS OR SERVICES, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Notice: Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages. In such jurisdictions, the Company's liability is limited to the fullest extent permitted by law. Kentucky consumer protection rights under KRS Chapter 367 are not waived by these limitations.

The Company is not responsible for losses arising from circumstances beyond its reasonable control, including but not limited to: carrier errors, natural disasters, governmental actions, utility failures, cyberattacks, or third-party platform outages.

Section 12

Indemnification

You agree to defend, indemnify, and hold harmless the Company, its owners, employees, agents, affiliates, and successors from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use of Company services in violation of these Terms
  • Any content, data, or materials you submit or provide to the Company
  • Your violation of any applicable law, regulation, or third-party right
  • Inaccurate shipping information, package declarations, or misrepresentation of contents
  • Any claim by a third party arising from your use of services

Section 13

Privacy and Data

13.1 Information We Collect

The Company may collect name, contact information, business details, payment information, shipping history, and usage data in connection with service delivery. Payment data is processed through PCI-compliant third-party processors and is not stored directly by the Company.

13.2 How We Use It

Customer information is used to provide services, process payments, communicate regarding accounts, and improve service offerings. The Company does not sell Customer personal information to third parties.

13.3 Communications

By providing your email address or phone number, you consent to receive transactional communications related to your account. Marketing communications are subject to your opt-in consent and comply with the CAN-SPAM Act (15 U.S.C. 7701 et seq.) and the Telephone Consumer Protection Act (TCPA, 47 U.S.C. 227). You may opt out of marketing communications at any time.

13.4 Data Retention

The Company retains Customer data for as long as necessary to provide services, comply with legal obligations, resolve disputes, and enforce agreements. Upon written request, the Company will delete personal data subject to legal retention requirements.

13.5 Third-Party Data Processors

The Company uses third-party platforms such as GoHighLevel (CRM), payment processors, and shipping carrier systems. Each such platform processes data under its own privacy policy. The Company is not liable for data handling by third-party platforms beyond its reasonable contractual obligations to those platforms.

Section 14

Intellectual Property

All trademarks, service marks, logos, brand names, and trade names associated with Horizon Pack & Ship and Horizon Business Hub are the exclusive property of the Company. Nothing in these Terms grants any license to use Company trademarks or branding.

All original content created by the Company — including but not limited to website copy, marketing materials, funnel templates, automation workflows, and training materials — is the intellectual property of the Company and may not be reproduced, distributed, or used without written permission.

Section 15

Dispute Resolution

15.1 Informal Resolution

Before initiating any formal dispute process, you agree to contact the Company in writing and provide at least 30 days for the Company to attempt to resolve the matter informally. This requirement does not waive any right to seek emergency injunctive relief.

15.2 Binding Arbitration

If informal resolution fails, disputes shall be resolved by binding arbitration administered in Hardin County, Kentucky, under the rules of the American Arbitration Association (AAA). The arbitrator's decision shall be final and may be entered as a judgment in any court of competent jurisdiction. Each party bears its own arbitration costs unless the arbitrator awards otherwise.

15.3 Class Action Waiver

YOU AND THE COMPANY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

15.4 Small Claims Exception

Either party may elect to have disputes resolved in Hardin County District Court small claims division, to the extent the claim falls within the court's jurisdictional limit, without first proceeding through arbitration.

Section 16

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to its conflict of law provisions. Federal law governs where applicable, including but not limited to federal consumer protection statutes, shipping regulations, and electronic commerce laws.

You consent to the exclusive jurisdiction of the state and federal courts located in Hardin County, Kentucky for any disputes not subject to arbitration under Section 15.

Section 17

Kentucky Consumer Rights

These Terms do not limit or waive any rights you have under the Kentucky Consumer Protection Act (KRS Chapter 367) or other applicable Kentucky consumer protection law. Specifically:

  • You have the right to cancel automatic renewal subscriptions at any time with no penalty under KRS 367.46951
  • The Company is prohibited from engaging in unfair, false, misleading, or deceptive acts or practices under KRS 367.170
  • Kentucky residents may file complaints with the Kentucky Attorney General's Consumer Protection Division at (888) 432-9257 or ag.ky.gov/consumer
  • Nothing in the arbitration clause prevents you from filing a complaint with a state or federal regulatory agency
Veterans: Horizon Pack & Ship is a veteran-owned business. The Company is committed to complying with all applicable laws protecting service members and veterans, including the Servicemembers Civil Relief Act (SCRA), 50 U.S.C. 3901 et seq.

Section 18

Federal Regulatory Compliance

The Company operates in compliance with all applicable federal regulations, including:

  • FTC Act (15 U.S.C. 45): No unfair or deceptive trade practices
  • CAN-SPAM Act (15 U.S.C. 7701): Compliant commercial email practices
  • TCPA (47 U.S.C. 227): Compliant SMS and phone marketing with consent
  • PHMSA Regulations (49 C.F.R.): Hazardous materials shipping compliance
  • Americans with Disabilities Act (ADA): Accessible service commitment
  • Electronic Fund Transfer Act (15 U.S.C. 1693): Compliant electronic payment and subscription billing disclosures
  • UCC Article 2: Sale of goods transactions comply with Kentucky's adoption of the Uniform Commercial Code

These Terms are intended to supplement, not replace, any rights or obligations established by applicable federal or state law. Where a provision of these Terms conflicts with a non-waivable legal right, the applicable law controls.

Section 19

Modifications to Terms

The Company reserves the right to modify these Terms at any time. Material changes will be communicated to active subscription holders via the email address on file no less than 14 days before the effective date. Non-material clarifications may be updated without advance notice.

Continued use of any Company service after the effective date of revised Terms constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must cancel any active subscriptions and discontinue use of services before the effective date.

The most current version of these Terms is always available at Company locations and on the Company website. The revision date at the top of this document indicates when the Terms were last updated.

Legal notices must be delivered in writing to the Radcliff address above. Notice is effective upon confirmed delivery. Email is not accepted for formal legal notice.

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force. The failure of the Company to enforce any right or provision does not constitute a waiver of that right or provision. These Terms, together with any applicable Statement of Work or Service Agreement, constitute the entire agreement between the parties regarding the subject matter herein.
